THAT:The recommendations contained in Report Nos. CDS-88-2013, CDS-89-2013, CDS-90-2013, CDS-91-2013 and CDS-93-2013 be and they are hereby approved. (

THAT:This report be received for information purposes, and a report on the Revised Draft Plan of Subdivision be presented to a future Council-in-Committee Meeting with the recommendations subsequent to the Public Meeting. (

THAT:Council hereby approves the Land Committee's recommended site located on Burnside Avenue (Site 2) unopened road allowance for a telecommunications tower, and further THAT:The stopping up and closing part of the Burnside Avenue unopened road allowance between Arcadia Street and Landsdowne Street be authorized and approved, and further THAT:The Town enter into a Lease Agreement with Bell Mobility Inc., to locate a telecommunication tower on part of the unopened Burnside Avenue Road Allowance so closed, in a form acceptable to the Town's legal counsel, and further COUNCIL-IN-COMMITTEE MINUTES – MONDAY, NOVEMBER 4, 2013 PAGE TEN THAT:The provisions of By-law No. 184-07 (Sale of Land Policy) be waived to permit entry into the Lease Agreement.. (

THAT:Council hereby authorizes a Town initiated amendment to the Town's Official Plan and the Comprehensive Zoning By-law No. 129-90 in accordance with the Ontario Planning Act for the lands owned by the District School Board of Niagara located at 255 Emerick Avenue (former Rose Seaton Public School). (

THAT:Council hereby authorizes staff to prepare a Downtown CIP for Ridgeway and update the Bridgeburg CIP in accordance with the steps outlined in this report, and further THAT:The incentive programs developed through this exercise serve as core model CIP programs for other existing downtown areas within approved Secondary Plans, and further THAT:Regional Development Services and Integrated Community Planning Departments, along with Ministry of Municipal Affairs receive a copy of this report for their information. (

THAT:Council hereby approves the modifications of the Conditional Building Permit Agreement for the construction of Model Homes as contained in the report. (

THAT:Council hereby extends Draft Plan Approval for the King Street Subdivision located at the northwest corner of King Street and Albany Street to COUNCIL-IN-COMMITTEE MINUTES – MONDAY, NOVEMBER 4, 2013 PAGE ELEVEN November 13, 2015, and that the owner and Regional Public Works Development Services Division be so advised. (

THAT:The recommendation be hereby amended by deleting the date “December 31, 2013” and inserting in lieu thereof the date “April 30, 2014.” (

THAT:In regard to correspondence received from the Solicitor acting on behalf of Rosehill Auction, Mr. Tom Richardson of Sullivan Mahoney dated October 29, 2013 and the undertakings therein, that the Municipal Council of the Town of Fort Erie hereby extends the date for completion of the Site Plan from October 31, 2013 to April 30, 2014. (

THAT:Staff submit a report to Council in January 2014 regarding the methodology and policies relating to the promotion and advancement of the Town’s sport facilities in conjunction with a Sports Tourism Strategy in co- operation with the EDTC. (

THAT:Council-in-Committee does now hereby adjourn at 8:17 p.m. (
