THAT:The time for the delegation be extended to fifteen (15) minutes. (

THAT:Council hereby adopts, in principle, and receives for information, the recommendations of the Fort Erie Public Transportation Requirements Study dated September 2011 (provided as Appendix "A"), and further THAT:Council hereby directs staff to tender the contract for the provision of conventional transit services within the Town of Fort Erie in accordance with recommendations held within the aforementioned study. (

THAT:Council hereby awards the contract for Road Resurfacing - Surface Treatment 2011 - Contract No. IS.11RSRF (ST) to 984265 Ontario Limited (Circle P Paving) at the tendered amount of $394,988.68 (including hst). (

THAT:Council hereby accepts the low tender for the 2011 Sidewalk Repair Program - Contract No. IS.11SIDE from 1526957 Ontario Limited (CTC Contracting) of Welland, Ontario in the amount of $197,943.23 (including hst), and further THAT:Council hereby further approves the removal/replacement of approximately 2457 square meters of sidewalk, to be funded from the Roads Reserve and as identified in Appendix "A". (

THAT:Council pass a resolution authorizing staff to release the entire 2011/2012 ice time allocation contract for the Fort Erie Figure Skating Club, and further THAT:The release of the above contract shall be subject to the Club agreeing to 30-day payment terms for all 2011/2012 charges with a continued commitment to reducing the current arrears balance, and further THAT:A future report be submitted to Council to provide an update on the Fort Erie Figure Skating Club. (

THAT:Venerino V. P. Panici Architect Inc. of St. Catharines, Ontario be retained to provide the Corporation of the Town of Fort Erie with architectural services for the Design of Fire Station No. 2 in the amount of $159,991.00 (including hst). (

THAT:Council hereby receives the interim financial report for the six months ending June 30, 2011 for information purposes. (

THAT:Council-in-Committee does now go into closed session at 7:40 p.m. to discuss the following: (a) Legal Matter (Pursuant to Section 239(2)(e) of Municipal Act, 2001 – Litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board and pursuant to Section 239(2)(f) of Municipal Act, 2001 – Advice that is subject to solicitor-client privilege, including communications necessary for that purpose) Re: Payment Out of Court of Tax Sale Proceeds – Roc Malz Construction Company Limited (Confidential Report No. CS-34-11) (

THAT:Council-in-Committee does now rise and reconvene into open session at 7:47 p.m. with report. (

THAT:Council authorizes the Town Solicitor to consent to an order for payment out of the Superior Court of Justice to the property owner after the one-year time limit has expired. (

THAT:The Municipal Council of the Town of Fort Erie hereby adjourns at 7:47 p.m. (
