THAT: The recommendations contained in Report Nos. CDS-54-12, CDS-58-12, CDS-59- 12, IS-24-12, IS-25-12, IS-26-12, CS-24-12, CS-26-12, CS-27-12, CS-28-12 and CS-29- 12 be and they are hereby approved. (

THAT:The recommendation be amended to allow for an extension of one (1) st year and the date May 1 , 2014 be hereby deleted and inserted in lieu thereof st the date May 1 , 2013 pursuant to the conditions set out in Appendix “4” to Report No. CDS-52-12, and further THAT:The applicant be so notified this is the final extension. (

THAT:Council extend Draft Plan Approval for the Bakersfield Subdivision 26T- 91016 (Phase 1) and the Bakersfield Subdivision 26T-91016 (Phase 2) until May 1st, 2014, and THAT:The Owner and Regional Public Works Development Services Division be so advised, and THAT:Conditions of Draft Plan Approval for the Bakersfield Draft Plan of Subdivision be amended as detailed in Appendix "4" to Administrative Report No. CDS-52-12, and THAT:The amended conditions of Draft Plan Approval be circulated to the applicable agencies in accordance with the requirements of the Planning Act. (

THAT:Council extend Draft Plan Approval for the Dominion Woods Phase 2 Draft Plan of Condominium located on the east side of Prospect Point Road, north of the Friendship Trail, be extended to August 14th, 2014, and THAT:The Owner and Regional Public Works Development Services Division be so advised, and THAT:Conditions of Draft Plan Approval for the Dominion Woods Phase 2 Draft Plan of Condominium be amended as detailed in Appendix "4" to Administrative Report No. CDS-53-12, and THAT:The amended conditions of Draft Plan Approval be circulated to the applicable agencies in accordance with the requirements of the Planning Act. (

THAT:The recommendation be hereby amended to approve the contract in the tender amount of $35,646.15 to supply and install 180 street trees. (

THAT:The contract to supply and install street trees throughout Fort Erie be awarded to Terratechnik Environmental Ltd. at an upset limit of $60,000 (excluding HST), and THAT:A by-law awarding the tender be submitted to Council, authorizing the Mayor and Clerk to execute the Contract Agreement. (

REPORT NO. CDS-60-12 – REQUEST FOR RELIEF FROM REQUIREMENTS OF FENCE BY-LAW NO. 150-08 – 3270 DOMINION ROAD THAT:The request for relief from the requirements of Fence By-law No. 150-08 for the height of a proposed fence in the rear yard at 3270 Dominion Road be allowed. (

THAT:The delegation’s time be extended an additional two (2) minutes. (

THAT:Council does now recess from Community and Development Services and moves into Corporate Services in order to hear the delegation. (

THAT:The Chair’s ruling in favour of allowing the delegation to continue be hereby granted. (

THAT:Council approve the Reserve Policy attached as Appendix "1", and THAT:The Brownfield CIP and Facade Improvement Reserve be consolidated and renamed Community Improvement Plan Financial Incentives with the purpose of supporting the Town's costs of financial incentives in accordance with approved Community Improvement Plans as approved from time to time, and THAT:The Office and IT Equipment Reserve is eliminated and it be replaced with the Office Furniture and Equipment Reserve with $47,490 and the IT Equipment Reserve with $71,235, and THAT:The Mapping Reserve is eliminated and the funds be allocated to IT Equipment Reserve, and THAT:The Fort Erie Business Park Reserve is eliminated and the balance of funds be transferred to the Roads Infrastructure Reserve and the matter of the future land sale proceeds of Industrial Business Park land be

THAT:The Municipal Council of the Town of Fort Erie hereby endorses by resolution the Human Resources and Skills Development Canada – Social Development Partnerships Program – Disability Component funding application for the “Accessible Washroom at Ferndale Park” project. (

THAT:Council-in-Committee does now hereby adjourn at 8:53 p.m. (
