Council-in-Committee

That: Council approves the Consent Agenda as recommended.

That: Council receives for information purposes Report CAO-10-2024 Mayor and Council Ontario Municipal Employees Retirement System (OMERS) Contributions; and further That: Council directs staff to prepare the necessary by-law to amend By-law 235-2001, being a by-law to authorize participation in the OMERS Pension plan for the head of Council and Councillors, as outlined in Report CAO-10-2024.

That: Council approves the Draft Plan of Subdivision dated February 15, 2024, for the lands known as 0-14166 Hendershot Drive, showing 7 Blocks for 29 street townhouse dwellings, a Block a road reserve, a Block for emergency access, and an extension of Hendershot Drive as illustrated in Appendix 2 of Staff Report PDS-50-2024, in accordance with the provisions of the Planning Act, R.S.O. 1990 c. P. 13 and the regulations thereunder, subject to the conditions contained in Appendix 3 of staff report PDS-50-2024, and further That: Council directs staff to circulate the Conditions of Draft Plan Approval in Appendix 3 of staff report PDS-50-2024 to the applicable agencies in accordance with the requirements of the Planning Act .

That: The Conditions of Draft Plan Approval in Appendix 3 be amended to include an additional condition that would require the installation of a sidewalk from the extent of the development toward the east to the extent of the existing sidewalk.

That: The Conditions of Draft Plan Approval in Appendix 3 be amended to include an additional condition that would require either easement access to the rear to the internal units or a pass through from the front of the unit to the rear through areas that does not include living areas.

That: The Conditions of Draft Plan Approval in Appendix 3 be amended to remove Condition 7 and replace it as follows: "The design for the public roads within the development be prepared by a Professional Engineer at a 20.0 m right-of-way full urban cross-section standard in accordance with the Town’s current standards, as amended to the satisfaction of the Director, Infrastructure Services."

That: Council extends draft plan approval for the Hershey Estates draft plan of subdivision until April 30, 2025, and the Owner and Regional Municipality of Niagara Planning and Development Services be so advised, and further That: Council directs that the conditions of approval for the Hershey Estates Draft Plan of Subdivision be amended as detailed in Appendix 3, and further That: Council determines in accordance with Section 51 (47) of the Planning Act, further notice is not required due to the minor nature of the changes.

That: The date for the extension be amended from September 30, 2025 to April 30, 2025.

That: Condition 30 of the conditions of approval for the Hershey Estates Draft Plan of Subdivision, detailed in Appendix 3, be amended to reflect revised date of April 30, 2025.

That: Council approves the designation of 1447 Ridge Road North as outlined in this report, for architectural, historical and contextual attributes and reasons, under Part IV of the Ontario Heritage Act; pursuant to the recommendation of the Museum and Cultural Heritage Advisory Committee, and further That: Council directs staff to prepare a Designation By-law and provide Notice of Intention to Designate in accordance with the Ontario Heritage Act .

That: Council approves the designation of 241 Ridge Road North as outlined in this report, for architectural, historical and contextual attributes and reasons, under Part IV of the Ontario Heritage Act; pursuant to the recommendation of the Museum and Cultural Heritage Advisory Committee, and further That: Council directs staff to prepare a Designation By-law and provide Notice of Intention to Designate in accordance with the Ontario Heritage Act .

That: Council approves the designation of 367 Crescent Road as outlined in this report, for architectural, historical and contextual attributes and reasons, under Part IV of the Ontario Heritage Act; pursuant to the recommendation of the Museum and Cultural Heritage Advisory Committee, and further That: Council directs staff to prepare a Designation By-law and provide Notice of Intention to Designate in accordance with the Ontario Heritage Act .

That: Council approves the designation of 651 Ridge Road North as outlined in this report, for architectural, historical and contextual attributes and reasons, under Part IV of the Ontario Heritage Act; pursuant to the recommendation of the Museum and Cultural Heritage Advisory Committee, and further That: Council directs staff to prepare a Designation By-law and provide Notice of Intention to Designate in accordance with the Ontario Heritage Act .

That: Council affirms its decision to state its intention to designate 304 Ridge Road North under Part IV, Section 29 of the Ontario Heritage Act

That: Council directs staff to prepare a by-law authorizing entry into an agreement with Niagara Boulevard Developments Inc. for the Brownfield Tax Assistance Program. That: Council directs staff to forward a copy of Report PDS-59-2024 to the Minister of Finance.

That: Council receives Report IS-06-2024 regarding the Farr Avenue Traffic Calming for information purposes, and further That: Council directs staff to include the cost of Farr Avenue Traffic Calming Trial Measures in the 2025 budget, for consideration.

That: Council receives Report IS-07-2024 regarding the Concession Road Traffic Calming for information purposes, and further, That: Council approves the installation of Traffic Calming Trial Measures on Concession Road between Garrison Road and Albany Street.
