Regular Council in Committee

That: Council approves the Consent Agenda Items as recommended. (

That: The motion be postponed to the December 12, 2016 Council meeting to obtain information relative to the cost of the septic systems. (

That: Council extends Draft Plan Approval for the Hershey Estates Draft Plan of Subdivision located on the north side of Nigh Road and east side of Centralia Avenue North until June 5th, 2017, and the Owner and Regional Municipality of Niagara Planning and Development Services Department be so advised, and further That: Council approves the amendment to the conditions of Draft Plan Approval for the Hershey Estates Plan of Subdivision as detailed in Appendix "5" to Report No. PDS-101-2016, and directs that the amended conditions of Draft Plan Approval be circulated to the applicable agencies in accordance with the requirements of the Planning Act. (

That: Council receives Report No. PDS-103-2016 for information purposes. (

That: Council waives the notification requirements of By-law No. 184-07 for Limited Marketability land, and further That: Council authorizes the sale of Town-owned land as indicated on Appendix "3" to Report No. PDS-104-2016 to the Applicant, Peninsula Plastics Limited, for the appraised value of $6,600.00 plus HST, subject to the land legally merging in title with the Applicant's abutting property, and further That: Council directs staff to submit a by-law to authorize entry into an Agreement of Purchase and Sale with the Applicant. (

That: Council receives Report No. PDS-105-2016 regarding the proposed amendments to the Town's Official Plan and Comprehensive Zoning By-law No. 129-90 to implement the Downtown Residential Parking Strategy for information purposes only, and further That: Council directs staff to present a report on the proposed amendments to the Town's Official Plan and Comprehensive Zoning By-law No. 129-90 to implement the Downtown Residential Parking Strategy at a future Council-in-Committee meeting with the recommendations following the Public Meeting. (

That: Council receives Report No. PDS-106-2016 regarding the proposed amendment to the King Street Draft Plan of Subdivision for information purposes only, and further That: Council directs staff to present a report on the proposed amendment to the King Street Draft Plan of Subdivision at a future Council-in-Committee meeting with the recommendations following the Public Meeting. (

That: Recommendation No. 8 be postponed to December 12, 2016 to obtain information regarding drainage and road elevation concerns. (

That: Council receives Report No. PDS-108-2016 regarding the proposed Combined Official Plan and Zoning By-law Amendment and Fort Erie Hills Draft Plan of Subdivision for information purposes only, and further That: Council directs staff to present a report on the proposed Combined Official Plan and Zoning By-law Amendment and Draft Plan of Subdivision for the Fort Erie Hills Subdivision at a future Council-in-Committee meeting with the recommendations following the Public Meeting. (

That: Council approves the changes to the landscape plans for the Ridgeway by the Lake Subdivision Phases 1 and 2 as outlined in Report No. PDS-109-2016. (

That: Council gives permission to the Developer of the Nigh Road Draft Plan of Subdivision to clear the trees Page 17 of 21 Council-in-Committee - 05 Dec 2016 Meeting Minutes within the limits of the proposed road allowance, and further That: Council requires the Developer to provide a letter of credit in the amount of $50,000 as a guarantee to limit the tree and vegetation clearing to the proposed road allowance, and further That: Council requires the Developer to sign an undertaking which will outline the terms of tree/vegetation clearing including the limits of clearing permitted, the requirement to register the subdivision prior to February 10, 2017 or as determined by the Director of Planning and Development Services, and the requirement to post the letter of credit as well as the Town’s right to cash the letter of credit in the instance that clearing takes place in excess of the agreed upon limits. (

That: The motion be postponed to the first Corporate and Community Services Committee meeting in March, 2017. (
