THAT:Section 3.3.2 of Council Rules of Procedure By-law No. 145-06, as amended be suspended in order to hold this Closed Session – Special Council-in-Committee Meeting with less than 48 hours notice of same due to the urgency of the matter. (

Re: Proposed Amendments to Minutes of Settlement – Canadian Motor Speedway – Ontario Municipal Board Hearing. (

THAT:Council-in-Committee does now rise and reconvene from closed session at 6:22 p.m. with report . (

THAT:Paul DeMelo of Kagan, Shastri, legal counsel acting on behalf of the Town of Fort Erie in the matter of the Canadian Motor Speedway Ontario Municipal Board Hearing, is hereby authorized and directed to execute an amended Consent between the parties, Richard Jukowsky, Carol Jukowsky, Michael Racey and Bridget Racey (Appellants) and th the Corporation of the Town of Fort Erie (Respondent) dated June 26 , 2012. (
