THAT:Report No. CDS-01-12 regarding Ridgeway Shores Phase 2 Draft Plan of Subdivision and Zoning By-law Amendment located at the northeast corner of Thunder Bay Road and Prospect Point Road be received for information purposes, and further COUNCIL-IN-COMMITTEE MINUTES – MONDAY, JANUARY 9, 2012 PAGE EIGHT THAT:A report on the Draft Plan of Subdivision and Zoning By-law Amendment be presented to a future Council-in-Committee Meeting with the recommendations subsequent to the Public Meeting. (

THAT:Council hereby extends Draft Plan Approval for the High Pointe Draft Plan of Subdivision located on the north side of Garrison Road, east of Sunset Drive until December 24, 2014, and further THAT:The Owner and Regional Public Works Development Services Division be so advised. (

THAT:Council hereby extends Draft Plan Approval for the Dominion Estates Draft Plan of Subdivision located on the south side of Dominion Road, east of Bardol Avenue until November 18, 2013, and further THAT:The Owner and Regional Public Works Development Services Division be so advised, and further THAT:Conditions of Draft Plan approval for the Dominion Estates Draft Plan of Subdivision be amended as detailed in Appendix 4 of Report No. CDS-03-12, and further THAT:The amended conditions of Draft Plan Approval be circulated to the applicable agencies in accordance with the requirements of the Planning Act. (

THAT:Council hereby extends Draft Plan Approval for the Spears Garden Draft Plan of Subdivision located east of Pettit Road, north of Garrison Road until December 8, 2013, and further THAT:The Owner and Regional Public Works Development Services Division be so advised, and further COUNCIL-IN-COMMITTEE MINUTES – MONDAY, JANUARY 9, 2012 PAGE NINE THAT:Conditions of Draft Plan Approval for the Spears Garden Draft Plan of Subdivision be amended as detailed in Appendix 4 of Report No. CDS-04-12, and further THAT:The amended conditions of Draft Plan Approval be circulated to the applicable agencies in accordance with the requirements of the Planning Act. (

THAT:Council formally adopt the Adopt-A-Park Program as a Town-wide program, and further THAT:A by-law be submitted to the Council Meeting of January 16, 2012 to adopt the Adopt-A-Park Program. (

THAT:Council hereby receives Report No. CDS-06-12 regarding Fort Erie Communities-in-Bloom and potential participation in the 2012 National Communities-in-Bloom Program, as background information for the January 18, 2012 budget deliberations, and further THAT:Subject to approval of the Communities-in-Bloom's 2012 budget request, Council authorizes staff to submit an application to participate in the National Communities-in-Bloom Competition. (

THAT:The South Coast Village at Crystal Beach Draft Plan of Subdivision dated November 2, 2011 showing 6 blocks for future dwellings, 2 blocks for mixed use, one lot fronting onto Crystal Beach Drive and one block for stormwater management as shown on Appendix 3 be approved in accordance with the provisions of the Planning Act, R.S.O. 1990 c.P.13 and the regulations thereunder, subject to the conditions contained in Appendix 8 of this report, and further THAT:The parties be advised of Council's decision on the application in accordance with the Planning Act, and further THAT:The conditions of Draft Plan Approval in Appendix 8 of Report No. CDS- 07-12 be circulated to the applicable agencies in accordance with the requirements of the Planning Act, and further THAT:The application to amend the Zoning By-law from the Neighbourhood Development (ND) Zone to a Site Specific Residential Multiple RM1 Zone and Core Mixed Use Zone be approved and a Zoning By-law Amendment be submitted to Council, and further COUNCIL-IN-COMMITTEE MINUTES – MONDAY, JANUARY 9, 2012 PAGE TEN THAT:Pursuant to Subsection 34(17) of the Planning Act, Council hereby determine that no further notices of the change be given regarding the change in zoning on Blocks 7 and 8 to reflect the new official plan designations. (

THAT:The Nigh Road Draft Plan of Subdivision dated November 10, 2011 showing a new roadway, 10 single detached dwelling lots and 2 blocks for environmental protection be approved in accordance with the provisions of the Planning Act R.S.O. 1990 c.P.13 and the regulations thereunder, subject to the conditions contained in Appendix 6 of this report, and further THAT:The parties be advised of Council's decision on the application in accordance with the Planning Act, and further THAT:The conditions of Draft Plan Approval in Report No. CDS-08-12 be circulated to the applicable agencies in accordance with the requirements of the Planning Act. (

THAT:Report No. CDS-09-12 regarding Rosehill Auction House Limited Site Plan be received for information purposes. (

THAT:This report be received by Council for information purposes. (

THAT:The Town enters into a Subdivision Agreement with 800547 Ontario Inc. for Village Creek Subdivision Phase 2 Stage 1 and 2, and further THAT:The Developer be allowed to pre-service the subdivision prior to the registration of the Subdivision Agreement subject to receipt of the final drawings, security deposit, cash payment, approvals, insurance certificate and letter of indemnification to the satisfaction of the Town, and further THAT:A by-law be submitted to Council authorizing the Mayor and Clerk to execute the Subdivision Agreement and associated documents. (

THAT:Pursuant to Section 16.9 of Procedural By-law No. 145-06, as amended, consent is hereby granted to consider a Corporate Services matter at this meeting due to extra- ordinary circumstances. (

THAT:By-law No. 93-06 be amended to remove the restriction on vehicular access on part of Windmill Point Road South to the extent of a line drawn between the south boundary of Part 19 on Reference Plan 59R-11256 on the COUNCIL-IN-COMMITTEE MINUTES – MONDAY, JANUARY 9, 2012 PAGE FIFTEEN easterly side of the said road, and Part 1 on Reference Plan 59R-11257 on the westerly side of the said road, and further THAT:The owner(s) of 2547 Windmill Point West Lane shall only be permitted to construct any future driveway entrance in a location approved by the Manager of Parks and Open Space Development and the Director of Infrastructure Services. (

THAT:The Municipal Council of the Town of Fort Erie does now hereby adjourn at 8:58 p.m. (
