That: Council approves the Consent Agenda Items as recommended. (

That: Council receives Report No. CAO-16-2016 for information purposes. (

That: Council receives for information revised Report No. COS-09-2016 regarding the 2017 Meeting Calendar and establishes the Council meeting dates for 2017 as set out in Appendix "2" attached thereto. (

Council approved a friendly amendment with unanimous consent to add “That: Council waives the Sale of Land Policy, and further”. Page 4 of 14 Regular Council - 12 Dec 2016 Meeting Minutes That: Council authorizes the stopping up, closing and sale of part of the Gilmore Road unopened road allowance between Con 10 & 11 Lot 5 NR Bertie, west of Farm Road, to the Applicants, Joseph & Cynthia Ann Defilippis, for the appraised value of $15,100.00 plus HST, and further That: Council directs that the sale be subject to the Applicants being responsible for all associated costs including completion of a Reference Plan, and the land legally merging in title with the Applicants' abutting property, and further That: Council waives the Sale of Land Policy, and further That: Council directs staff to submit a by-law to authorize entry into an Agreement of Purchase and Sale with the Applicants once the Reference Plan is completed. (

That: Council receives Report No. PDS-107-2016 regarding proposed amendments to the Deerwood Lane Draft Plan of Condominium for information purposes only, and further That: Council directs staff to present a report on the proposed amendment to the Deerwood Lane Draft Plan of Vacant Land Condominium at a future Council-in-Committee meeting with the recommendations following the Public Meeting. (

That: Council accepts the resignation of Mary Hesser from the Fort Erie Public Library Board, and further That: Council directs staff to proceed with filling the vacancy in accordance with the provisions of the Procedural By-law. (

That: Council accepts the resignation of Nancy Niznik from the Ridgeway Business Improvement Area Board of Management, and further That: Council directs staff to proceed with filling the vacancy in accordance with the provisions of the Procedural By-law. (

That: Council accepts the resignation of Jessica Carthew from the Fort Erie Active Transportation Committee, and further That: Council directs staff to proceed with filling the vacancy in accordance with the provisions of the Procedural By-law. (

That: Council accepts the resignation of David Pantano from the Accessibility Advisory Committee, and further That: Council directs staff to proceed with filling the vacancy in accordance with the provisions of the Procedural By-law. (

That: Council appoints John Folusewych (effective January 1, 2017) as a Beachcomber to the Senior Citizens Advisory Committee for the period ending November 30, 2018. (

That: Council dispenses with notice in accordance with section 14.1 a) of the Council Rules of Procedure to allow a motion to reconsider. (

That: the motion regarding approval of changes to the landscape plans for the Ridgeway by the Lake Subdivision be amended as follows: To release them from everything save and except the properties identified where residents have stated the desire to have the works completed; Planning staff will send a letter to the 18 properties identified as not having responded to the original request, wording to be confirmed by Planning staff but paraphrasing that should the resident wish to have the works completed on their property as identified in the original plan they are to notify Planning staff Page 8 of 14 Regular Council - 12 Dec 2016 Meeting Minutes prior to June 1, 2017; Any residents wishing for the works to be completed, the developer will complete these works prior to October 1, 2017; All monies currently held as a security on the originally proposed landscape plan will be returned to the developer save and except $20,000 which is estimated as the funds necessary to complete the works on the 18 properties; and finally These funds will be returned once works are completed and/or no requests come forward for the works to be completed. (

That: Council waives the rules of procedure to allow new business related to the delegation. (

That: The $7500 request from the Dominion Repertory Theatre be included for consideration in the 2017 Budget deliberations. (

That: The motion regarding a reduction of the speed limit on Point Abino Road be postponed until the Regular Council Meeting in June, 2017 to allow for a traffic study to be done. (

That: The by-law package containing: 137-2016: To Authorize the Execution of a Subdivision Agreement with 800547 Ontario Limited (Ed Lenchyshyn) - (Village Creek Phase 3 – Stage 1) 138-2016: To Authorize a Lease Agreement with SBA Canada, ULC for a Telecommunication Tower at 1818 Pettit Road (Gibson Centre) 139-2016: To Approve the Execution of a Memorandum of Understanding between The Regional Municipality of Niagara and Crime Stoppers of Niagara Inc. (Illegal Dumping Reward Initiative) 141-2016: To Deem a Certain Registered Plan of Subdivision Not to be a Registered Plan of Subdivision - Winifred Swalm (3880 Victoria Avenue) 143-2016: To Establish the Transit Advisory Committee and Approve its Terms of Reference Is given first and second reading. (

That: By-laws: 137-2016 138-2016 139-2016 141-2016 143-2016 be given third and final reading to be signed by the Mayor and Clerk under the corporate seal. (

That: By-law 142-2016: To Exempt Certain Lots in Plan 59M-418 from Part Lot Control – Ridgeway By The Lake Subdivision - Phase 3 - 53, 57 and 61 Butlers Drive - Blythwood Homes Inc. is given first and second reading. (

That: By-law 142-2016 be given third and final reading to be signed by the Mayor and Clerk under the corporate seal. (

That: By-law 140-2016: To Authorize the Sale of Land on the North Side of Industrial Drive to Peninsula Plastics Limited (Part Lot 5, Concession 2 Niagara River, Bertie, being Parts 3 & 5, 59R-7798) is given first and second reading. (

That: By-law 140-2016 be given third and final reading to be signed by the Mayor and Clerk under the corporate seal. (

That: By-law No. 144-2016: To Confirm the Actions of Council at its Meeting Held on December 12, 2016 is given first and second reading. (

That: Council does now go into closed session at 7:48 p.m. to discuss the following: Property Matter (Pursuant to Section 239 (2) (c) of the Municipal Act, 2001 - a proposed or pending acquisition or disposition of land by the municipality or local board) (

That: Council does now rise and reconvene from closed session at 8:10 p.m. with report that staff proceed as directed. (

That: Council adjourns at 8:10 p.m. to reconvene into a Regular Meeting of Council on January 23, 2017. (
