THAT:The order of the agenda be changed to deal with delegations and reports under Corporate Services first however, the minutes will reflect the order of the agenda, as printed. (

THAT:Council hereby receives Report No. IS-46-10 as an update on the implementation plan for Fort Erie Wayfinding Signage for the various BIA areas of the Town. (

THAT:Taylor Hazell Architects Ltd. of Toronto, Ontario be retained to provide the Corporation of the Town of Fort Erie with consulting services for the Point Abino Lighthouse Restoration Project in the amount of $87,512.85 (including hst). (

THAT:Recommendation No. 2 of Appendix “2” to the report be amended by including “THAT:PALPS be permitted to have the Willowbank School of Restoration Arts subject to PALPS negotiating access with the Point Abino Association and providing public liability insurance and indemnity.” (

THAT:Council hereby approves the September 13, 2010 Land Committee Meeting Minutes attached as Appendix "1" to Report No. CAO-11/LC-07-10, and further THAT:Council hereby approves the recommended tasks outlined in Appendix "2" to Report No. CAO-11/LC-07-10. (

THAT:Council hereby approves the Water Financial Plan attached as Appendix "A" as a financially viable plan for the operation of the Town's drinking water system in accordance with the O. Reg. 453/07 of the Safe Drinking Water Act, 2002. (

THAT:The list of taxed and penalties totalling $31,325.38, attached as Appendix "A" to Report No. CS-41-10 be cancelled, reduced or refunded as applicable in accordance with Section 357 and 358 of the Municipal Act, 2001 and direct staff to prepare the appropriate by-law. (

THAT:The Town enter into a short-term extension of the lease of Part of Block "A", Plan 995 on the west and east sides of Point Abino Road South, with the Bertie Boating Club for a term of two (2) years with an option to renew for one (1) additional year at the Town's option. (

THAT:Staff be directed to negotiate a lease agreement with the Bertie Boating Club for a term of twenty-five (25) years and that staff report back to Council accordingly. (

THAT:The Municipal Council of the Town of Fort Erie hereby suspends Council Rules of Procedure By-law No. 145-06, as amended to alter the meeting schedule due to the 2010 Municipal Elections and establishes the October, November and December 2010 and January 2011 meeting schedules as follows: October 4, 2010 - Council-in-Committee October 12, 2010 - Council November 8, 2010 - Council November 22, 2010 - Council December 6, 2010 - Inaugural Meeting December 13, 2010 – Council COUNCIL-IN-COMMITTEE MINUTES – MONDAY, SEPTEMBER 20, 2010 PAGE EIGHT January 10, 2011 - Council-in-Committee January 17, 2011 - Council January 24, 2011 - Council-in-Committee January 31, 2011 - Council, and further THAT:In the event it is necessary for Council to consider any reports, they shall be included under Committee-of-the-Whole of a Council Meeting. (

THAT:Council-in-Committee resume the Closed Session recommendations. (

THAT:The Municipal Council of the Town of Fort Erie hereby receives the letter dated September 9, 2010 from Mr. Ed Forthergill representing Molinaro Group Crystal Beach Waterfront Inc. describing certain design modifications to the proposed Crystal Beach Gateway Project and hereby approves the design modifications described therein, and further THAT:The Town Solicitor be directed to instruct legal counsel acting for the Town in the OMB Hearing respecting the appeal of Zoning By-law No. 26-10 as follows: - as required to implement the design modifications approved by Council on September 20, 2010, and - to extend the application of the “H” Holding Symbol as requested by the Regional Municipality of Niagara in their letter dated January 20, 2010 and as requested by the Niagara Peninsula Conservation Authority in their letter dated February 17, 2010. (

THAT:Pursuant to Section16.9 of Procedural By-law No. 145-06, as amended, consent is hereby granted to consider a Community and Development Services matter at this meeting due to extra-ordinary circumstances. (

THAT:The Fire Chief be delegated authority to enter into Facility Use Agreements with municipalities and other agencies for the use of the Fire Training Facility for training and educational exercises, and further THAT:The Fees and Charges By-law be amended to include a $400 per day fee for the use of the facility. In addition, a variable charge for the use of the classroom be established to take into consideration, the number of users, length or use and equipment requested. (

THAT: The Municipal Council of the Town of Fort Erie hereby adjourns at 8:16 p.m. (
