Whereas Rick Shular, Councillor, Ward Two passed away on December 29, 2014; and Whereas the Municipal Act, 2001, subsection 259(1) provides that the office of a member of council of a municipality becomes vacant if the member dies; and Whereas subsection 262(1) of the Act provides that if the office of a member of a council becomes vacant as a result of the death of a member, the council shall declare the office to be vacant at either of its next two meetings; Now therefore the Council of the Corporation of the Town of Fort Erie declares the office of Councillor, Ward Two, to be vacant. (

That: The Municipal Council of the Town of Fort Erie hereby adjourns at 7:30 p.m. to reconvene into Special Meeting of Council on Monday, January 26 , 2015 immediately following the Regular Council-in- Committee Meeting. (
