THAT:Section 16.9 of Council Rules of Procedure By-law No. 145-06, as amended, be waived in order to permit the delegation since it is a non-related matter on the agenda. (

THAT:The delegation time limit be extended beyond ten (10) minutes. (

THAT:Council hereby receives Report No. CDS-01-10 regarding the Communities-in-Bloom Program for information purposes, and further THAT:Council hereby authorizes the submission of an application to participate in the 2010 National Communities-in-Bloom Program in the "Friends Category." pursuant to the recommendation of the Communities-in-Bloom Committee. (

THAT:Pursuant to Section 16.9 of Procedural By-law No. 145-06, as amended, consent is hereby granted to consider Infrastructure Services and Corporate Services matters at this meeting due to extra-ordinary circumstances. (

THAT:Council hereby receives Report No. IS-01-10 for information purposes and for reference in upcoming 2010 Budget deliberations when considering levels of service in the Transit Operating Budget. (

THAT:Council enter into an Endangered Species Act Agreement with the Ministry of Natural Resources which allows the Town of Fort Erie to maintain some of its existing Municipal Drains without acquiring a permit. (

THAT:Council hereby accepts a Section 4 Drainage Act Petition, from landowners on House Road, north of Gilmore Road, attached as Appendix "A", for a new Municipal Drain, and authorizes the Drainage Superintendent to proceed in accordance with the Drainage Act Legislation, RSO 1990, c17. (

THAT:Council proceeds with the drainage works for the Winger Road Municipal Drain in accordance with the Drainage Act, RSO 1990, c.17, and further THAT:Council award the tender for construction of the Winger Road Municipal Drain at the tendered amount of $38,835.30 including 5% g.s.t. to Belchior Contracting and Excavating Ltd. of St. Catharines, Ontario, and further THAT:Council hereby authorizes interim financing of expenditures for construction of the Winger Road Municipal Drain from Capital Account 835.09WNGR, to be repaid by the benefiting property owners, and further THAT:Staff be directed to prepare the necessary by-law to authorize the Mayor and Clerk to execute the contract on behalf of the Town of Fort Erie, and further THAT:The $30,000 originally budgeted for the Winger Road Municipal Drain from the Federal Gas Tax Reserve be substituted with funding from the Storm Drainage Refurbishing Reserve. (

THAT:The amended purchasing/tendering policy attached as Appendix "A" to Supplemental Report No. CS-45-01-09 be received by Council, and further THAT:Staff be directed to prepare the necessary by-law to adopt the policy attached as Appendix "A" at the Council Meeting of January 18, 2010. (

THAT:The Town provide a conditional grant in the amount of $500,000 to the Fort Erie Live Racing Consortium annually for a three year period commencing in 2010, to be funded from slot machine revenues, and further THAT:The Mayor and Clerk be authorized to execute a Grant Funding Agreement with the Fort Erie Live Racing Consortium, on the terms and conditions identified in Report No. CAO-01-2010 and satisfactory to the Town Solicitor, and further THAT:The CAO be nominated to the Board of Directors of the Fort Erie Live Racing Consortium (FELRC) as a Town Representative. (

THAT:Council-in-Committee does now hereby adjourn at 8:20 p.m. (
