That: Council approves the Consent Agenda as recommended.

That: Council extends draft plan approval for the Black Creek Signature Phase 2 Draft Plan of Subdivision located at the north side of Baker Road and east side of Netherby Road until September 9, 2025, and the Owner and Regional Municipality of Niagara Planning and Development Services Department be so advised, and further That: Council directs that the conditions of approval for the Black Creek Signature Phase 2 Draft Plan of Subdivision be amended as detailed in Appendix “4” to Report PDS-72-2023, and further That: Council determines in accordance with Section 51 (47) of the Planning Act , further notice is not required due to the minor nature of the changes.

That: Council approves the amendment to the Town's Zoning By-law 129-90 as detailed in Report PDS-74-2023 for the lands known as 3458 Black Creek Road, and further That : Council directs that the Holding Provision not be removed until sufficient sanitary capacity is available, to the satisfaction of the Town, and further That: Council directs staff to submit the necessary by-law, and further That: Council approves the Draft Plan of Subdivision for 3458 Black Creek Road, showing 6 lots for a total of 6 townhouse dwellings and 2 lots intended for a semi-detached dwelling as illustrated in Appendix "2" of Report PDS-74-2023, in accordance with the provisions of the Planning Act, R.S.O. 1990 c. P. 13 and the Regulations thereunder, subject to the conditions contained in Appendix "3" of Report PDS-74-2023, and further That: Council directs staff to circulate the Conditions of Draft Plan Approval in Appendix "3" of Report PDS-74-2023 to the applicable agencies in accordance with the requirements of the Planning Act .

That: Council amend condition 11 of report PDS-75-2023, to read as follows: 11. That the owner shall either construct a 1.50m wide concrete sidewalk along the full frontage of the subject lands or submit a financial contribution in accordance with the Town’s current average tender document pricing at the time of payment for the purpose of constructing the sidewalk in the future, to the satisfaction of the Director of Infrastructure Services.

That: Council approves the amendment to the Town's Zoning By-law 129-90 as detailed in Report PDS-75-2023 for the lands known as 1101 DiPietro Street, and further That: Council directs that the Holding Provision not be removed until sufficient sanitary capacity is available, to the satisfaction of the Town, and further That : Council directs staff to submit the necessary by-law, and further That: Council approves the Draft Plan of Subdivision for 1101 DiPietro Street, showing 3 Blocks for a total of 18 townhouse dwellings as illustrated in Appendix "2" of Report PDS-75-2023, in accordance with the provisions of the Planning Act, R.S.O. 1990 c. P. 13 and the Regulations thereunder, subject to the conditions contained in Appendix "3" of Report PDS-75-2023, and further That: Council directs staff to circulate the Conditions of Draft Plan of Subdivision Approval in Appendix "3" of Report PDS-75-2023 to the applicable agencies in accordance with the requirements of the Planning Act , and further That: Council amend condition 11 of report PDS-75-2023, to read as follows: 11.
