Regular Council in Committee

THAT:Report No. CDS-54-10 regarding Official Plan and Zoning By-law Amendments to implement the Gateway Secondary Plan be received for information purposes, and further THAT:Council consider the retention of a qualified arbourist subject to budget approval in 2011, to conduct an Existing Conditions Survey of the area north of Garrison Road and west of Mather Boulevard, to assist in determining an appropriate location for a neighbourhood park and/or natural buffer areas, and further THAT:A report on the Official Plan and Zoning By-law Amendments be presented at a future Council-in-Committee Meeting with the recommendations subsequent to the Public Meeting and community consultation. (

THAT:The request received from Cheryl Thrasher for relief from Fence By-law No. 150-2008 to permit a privacy hedge greater than 1.0 metres in height in a front yard be denied. (

THAT:Council hereby supports the comments of Report No. CDS-56-10, and further THAT:A copy of this report be forwarded to the Ministry of Municipal Affairs as the Town's comments on the review of the Provincial Policy Statement, and further THAT:A copy of this report be forwarded to the Regional Municipality of Niagara and Town's Environmental Advisory Committee for information purposes. (

THAT:Council hereby appoints AMEC Earth and Environmental Limited of Burlington, Ontario as the Drainage Engineer for the preparation of a new Engineer's Report for the Zavitz Municipal Drain in the amount of $24,990.00 (including h.s.t.), and further THAT:The budget for Capital Project ZAVI04, Zavitz Municipal Drain be increased to reflect the seven thousand five hundred dollar contribution from benefiting landowners, and further THAT:The allocation of $15,000.00 originally budgeted for the Zavitz Municipal Drain from the Federal Gas Tax Reserve be substituted with funding from the Storm Drainage Refurbishing Reserve, and further THAT:Staff be authorized to prepare the by-law authorizing the Mayor and Clerk to execute the contract on behalf of the Town of Fort Erie, and further THAT:Staff be directed to notify the City of Port Colborne of the appointment of AMEC Earth and Environmental Limited for the aforestated works. (

THAT:Council hereby appoints Urban Environmental Management Limited of Niagara Falls, Ontario as the Drainage Engineer for the preparation of a new Engineer's Report for the Outlet Municipal Drain in the amount of $55,307.85 (including h.s.t.), and further THAT:The costs of the Engineering Report be charged to Capital Project OUTD04, Outlet Municipal Drain, and further THAT:The allocation of $65,000.00 originally budgeted for the Outlet Municipal Drain from the Federal Gas Tax Reserve be substituted with funding from the Storm Drainage Refurbishing Reserve, and further COUNCIL-IN-COMMITTEE MINUTES – MONDAY, OCTOBER 4, 2010 PAGE SEVEN THAT:Staff be authorized to prepare the by-law authorizing the Mayor and Clerk to execute the contract on behalf of the Town of Fort Erie. (

THAT:A by-law be submitted to Council to appoint persons to the Niagara Compliance Audit Committee as recommended by the Nomination Committee. (

THAT:Council hereby receives Report No. CS-45-10 for information purposes only. (
