THAT: Council-in-Committee does now go into Closed Session to discuss the following: (a) Legal Matter Re: Cambone Rezoning Appeal (

THAT: Council-in-Committee does now rise and reconvene with the following report: THAT: The following resolution be presented to Council for consideration: THAT: The Municipal Council of the Town of Fort Erie hereby endorses the draft by-law attached hereto as Schedule “A” for the purposes of settlement of the Cambone OMB Hearing scheduled for September 17th, 2001 including the requirement for a Site Plan Agreement, subject to Augusto Cambone conveying to the Town the lands identified on the sketch attached hereto as Schedule “B” as Nos. 7, 8 and 9 in the amount of $2,500.00 payable by the Town, and the Town in turn granting a right-of-way to the abutting property owners identified as Nos. 3 and 4 on Schedule “B” in order to perfect access, or alternatively Augusto Cambone granting a right-of-way in perpetuity to the aforesaid property owners and an easement in perpetuity to the Town for sewer purposes, and further THAT: The Town solicitor shall have the absolute discretion at the OMB Hearing to settle this matter in the best interests of the Town and the adjacent property owners. (
