THAT:Council hereby receives the Winter Control Plan for 2010-2013 as the updated operating protocol for the Town of Fort Erie, and further THAT:Council hereby directs staff to prepare a by-law to adopt the Winter Control Plan for 2010-2013. (

THAT:Council hereby approves the January 13, 2011 Land Committee meeting minutes attached as Appendix "1" to Report No. CAO-02/LC-01-11. (

THAT:Report No. CS-03-11 be received for information purposes. (

THAT:The Municipal Council of the Town of Fort Erie hereby suspends Council Rules of Procedure By-law No. 145-06, as amended due to March Break and establishes the March Meeting Schedule as follows: March 7, 2011 - Council-in-Committee March 14, 2011 - Cancelled March 21, 2011 - Council March 28, 2011 - Council-in-Committee and Council (

THAT:Pursuant to Section 16.9 of Procedural By-law No. 145-06, as amended, consent is hereby granted to consider a Community and Development Services matter at this meeting due to extra-ordinary circumstances. (

THAT:Section 2.4 of the Terms of Reference be amended to include the General Manager of Gaming, Health and Wellness as a “voting member of the HAS Committee.” (

THAT:Section 8.2 be amended to delete after the word “inclusion” the following words “in the Council Agenda no later than two (2) working days” and inserting in lieu thereof the words “on the next Council Agenda.” (

THAT:A by-law be submitted to Council to establish a "Hospital Services Committee" pursuant to the revised Terms of Reference, as amended, attached as Appendix "A" to Report No. CDS-03-11. (

THAT:Council-in-Committee does now move from open session into closed session at 6:38 p.m. to discuss the following: (a) Property Matters (Section 239(c) proposed or pending acquisition or disposition of land by the municipality) (i) Site Location Options for Replacement of Fire Station No. 2 (Confidential Report No. CDS-04-11) (ii) Update on the Point Abino Lighthouse Restoration Project and Disposition of Lighthouse Keeper's Dwelling (Confidential Report No. CS-04-11) (b) Legal Matter (Section 239(f) advice that is subject to solicitor-client privilege) (i) Indemnification of Board of Directors of Fort Erie Live Racing Consortium (

THAT:Council-in-Committee does now rise and reconvene from closed session into open session at 8:32 p.m. with the following reports. (

THAT:Staff be authorized to enter into discussions with the owners of the identified properties, as amended, to ascertain the availability of the lands, and the anticipated cost of acquiring the land, and further THAT:Staff be directed to investigate site remediation and other costs associated with each of the subject lands, and further THAT:Staff prepare a subsequent report identifying a preferred site for Council’s consideration. (

THAT:The Town Solicitor be directed to act in accordance with Option (a) as contained in Confidential Report No. CS-04-11. (

THAT:The Town Solicitor be directed to further investigate the matter of indemnification of FELRC and EDTC Town nominated board members and report back to Council accordingly. (

THAT:The Municipal Council of the Town of Fort Erie hereby adjourns at 8:35 p.m. (
