THAT:The hour of adjournment be extended beyond 10:00 p.m. (

THAT:Council permit Mr. Palmer to appear before Council to answer questions to his report. (

1. THAT:The application by the Town of Fort Erie and the Molinaro Group, to amend the Zoning By-law to permit the development of a 12-storey, 87 unit residential building with ground floor commercial and public assembly space at 4155 Erie Road be approved and that the requisite amending Site Specific By-law be submitted to Council for adoption, and further 2. THAT:The implementing Site Specific Zoning By-law Amendment contain a Holding provision which shall not be removed until a Site Plan Agreement pursuant to Section 41 fo the Planning Act and a Development Agreement pursuant to Section 37 of the Planning Act have been entered into to the satisfaction of the Town; and the requirements of the Niagara Peninsula Conservation Authority as outlined in their letter of February 17, 2010 and attached as Appendix "9" have been addressed to their satisfaction, and further 3. THAT:The Site Plan Agreement contain appropriate provisions to address the requirements of the "Overall Benefit Permit" pursuant to Section 17.2(c) of the Endangered Species Act and appropriate screening measures for the abutting properties at 4183 and 4131 Erie Road and 432 Schooley Road, and further COUNCIL-IN-COMMITTEE MINUTES – MONDAY, MARCH 1, 2010 PAGE THIRTY 4. THAT:Council hereby receives the planning opinion by Mr. Ron Palmer, attached as Appendix "3" to this report, and that it consider including supplemental Recommendation Nos. 3 to 5 in future work plans. 5. THAT:Council hereby extends Draft Plan Approval for the Garrison Green Draft Plan of Subdivision located on the south side of Garrison Road, west of Concession Road until May 9, 2012, and further THAT:The owner and Regional Public Works Development Services Division be so advised. (

THAT:Council hereby extends Draft Plan Approval for the Abino Dunes Draft Plan of Condominium located on the west side of Point Abino Road, until September 23, 2011, and further THAT:The owner's Solicitor and Regional Public Works Development Services Division be so advised. (

THAT:Staff provide a full accounting to Council of the monies spent by the Town on the Public/Private Partnership for Bay Beach including all advertising related to the development and public notices, staff wages and external costs. (

THAT:Pursuant to Section 16.9 of Procedural By-law No. 145-06, as amended, consent is hereby granted to consider a Corporate Services matter at this meeting due to extra- ordinary circumstances. (

THAT:Council hereby approves the February 8, 2010 Land Committee Meeting Minutes attached as Appendix "1" to Report No. CAO-04-10/LC-02-10. (

THAT:The Senior Utility Relief Fund (SURF) be implemented for 2010 as per Administrative Policy Directive, APD 01-2010 attached as Appendix "A" with $15,000 from the Water Refurbishing Reserve. (
