That: Council approves the Consent Agenda Items as recommended save and except items 9.2.2 (b), 9.2.2 (d) and 9.2.3 (b). (

1. Whereas Solar Power Network (the “Applicant”) proposes to construct and operate a Rooftop Solar System (the “Project”) on 20 Lewis Street (the “Lands”) in the Town of Fort Erie, under the Province’s FIT Program, and Whereas the Applicant has requested the Council of the Town of Fort Erie to indicate by resolution Council’s support for the construction and operation of the Project on the Property, and Page 8 of 15 Regular Council - 14 Nov 2016 Meeting Minutes Whereas pursuant to the FIT Rules, Version 5.0, Applications whose Projects receive the formal support of Local Municipalities will be awarded Priority Points, which may result in the Applicant being offered a FIT Contract prior to other Persons applying for FIT Contracts; Now therefore be it resolved that the Council of the Town of Fort Erie supports the construction and operation of the Project on the Lands, subject to building permit approvals, and further That: It is hereby acknowledged the sole purpose of this resolution is to enable the Applicant to receive Priority Points under the FIT Program and may not be used for the purpose of any other form of municipal approval in relation to the Application or Project, or for any other purpose. 2. That: Council approves Consent Agenda item 9.2.3 (b) as recommended. Resolution No. 5 Moved by: Councillor Butler That: Council amends item 9.2.3 (b) by adding the following: “and change the proposed street name from Brady Drive to Plato Drive in the Spears-High Pointe Subdivision.” (

That: Council accepts the resignation of Mike Daigle from the Bridgeburg Station Downtown Business Improvement Area Board of Management, and further That: Council directs staff to proceed with filling the vacancy in accordance with the provisions of the Procedural By-law. (

That: Council accepts the resignation of Dave Renshaw from the Museum and Cultural Heritage Advisory Committee, and further That: Council directs staff to proceed with filling the vacancy in accordance with the provisions of the Procedural By-law. (

That: Council accepts the resignation of Sue Williams from the Senior Citizens Advisory Committee, and further That: Council directs staff to proceed with filling the vacancy in accordance with the provisions of the Procedural By-law. (

That: Council accepts the resignation of Ellen Burd from the Senior Citizens Advisory Committee, and further That: Council directs staff to proceed with filling the vacancy in accordance with the provisions of the Procedural By-law. (

That: Council hereby determines that in accordance with Section 34(17) of the Planning Act, further notice is not required to rezone the lots on the south side of Bertie Street, east of Sunset Drive from Environmental Protection EP Zone and Rural RU Zone with an Environmental Conservation Overlay to a Rural RU Zone. (

That: Council directs staff to prepare a report regarding the request of Niagara Solar Power Company Ltd., for the Council- in-Committee Meeting of November 21, 2016. (

That: Council directs staff to prepare a report relative to telecommunications towers and further municipal consultation and mechanisms of control if possible, and further notification opportunities for residents throughout the process. (
