THAT: Council receive this Status Report on Unaccounted for Water Reduction for information purposes only. (

THAT: Council accept the Abino Bay Beach Management Agreement, and further THAT: A by-law be submitted to the next meeting of Council authorizing entering into the Abino Bay Beach Management Agreement with the Ministry of Natural Resources. (

THAT: Council support an extension of draft plan approval for New Haven Estates to December 23, 2004, and further THAT: Council approve the amendments to the conditions of draft plan approval as outlined in Appendix “2”, and further THAT: The owners and the Regional Municipality of Niagara Planning and Development Department be so advised. (

THAT: This report be received for information purposes, and further THAT: A copy of this report and its recommendations be forwarded to the Regional Clerk, Regional Planning and Development Department and Niagara Peninsula Conservation Authority. (

THAT: A zoning by-law amendment be submitted to Council amending the zoning of the subject lands from “Rural RU”, “Estate Residential ER” and “Estate Residential ER-4 Zone” to a Site Specific “Estate Residential Holding ER-H Zone” permitting a building with three dwelling units and recognizing the lot frontage and lot area of the property, and further THAT: The Clerk be authorized to discharge the existing development agreement registered against the subject lands after the zoning by-law amendment comes into force. (

THAT: A zoning by-law amendment be submitted to Council amending the Town of Fort Erie Comprehensive Zoning By-law No. 129-90 by rezoning the subject lands from “Residential Development RD Zone” to “Open Space OS Zone” for the storm water management facility and public walkways and by changing the provisions of the Site Specific “Residential 2A R2A-234 Zone” and “Residential 2A R2A-235 Zone” to permit the lots to front on public roads and to reduce the setback for detached garages on private laneways, and further THAT: Draft Plan approval for the Erie Beach Phase 1B Draft Plan of Subdivision be extended to October 31, 2002. (

THAT: A by-law be submitted to Council authorizing the entering into an agreement with D&D Amusements for the operation of amusement machines in the Town of Fort Erie Leisureplex for a period of 5 years commencing August 1, 2002, and further THAT: A by-law be submitted to Council authorizing the entering into of an agreement with Don Fulton & Sons for the operation of amusement machines at the Crystal Ridge Community Centre for a period of 5 years commencing August 1, 2002. (

THAT: Council-in-Committee does now go into closed session to discuss the following: (a) Property Matter Re: Land Committee Minutes - June 26, 2002 (b) Property Matter Re: Acquisition of waterfront property (

THAT: The Municipal Council of the Town of Fort Erie hereby waives Section A5.4 of Council Rules of Procedure By-law No. 200-85, as amended to extend the hour of adjournment beyond 9:30 p.m. (

THAT: Council-in-Committee does now hereby rise and reconvene with the following report: THAT: Staff be directed to act in accordance with the instructions of Council. (
